What will you find in this document?
This document describes the rules for processing personal data obtained through cookies and other similar technologies used in the greenpharmcosmetic.eu online store (the “Service”), and also informs you of the rights you have regarding the protection of personal data.

1. §1. Controller

   The controller of your personal data is us, that is:

   In the remainder of this document we refer to ourselves as the “Controller” or use the form “we”. The Controller’s registration records are kept by the District Court for Kraków-Śródmieście.

   The Controller has not appointed a Data Protection Officer. In matters related to the protection of personal data you may contact the Controller directly.

2. §2. Joint controllership of data

   Within the Service, the personal data of Users obtained through cookies for analytical, marketing, remarketing and personalisation purposes may also be processed by third parties (joint controllers).

   The joint controllers of the data may in particular be:

   1. Google Ireland Ltd. (Ireland) – analytics, remarketing, Google Ads;
   2. Meta Platforms Ireland Limited (Ireland) – advertising and remarketing on social media;
   3. TikTok Technology Limited (Ireland) – advertising campaigns and analytics;
   4. Pinterest Europe Ltd. (Ireland) – personalisation of advertising content;
   5. YouTube LLC / Google LLC (USA) – video content analytics;
   6. other providers of marketing and analytical tools, if implemented in the Service.

   Each joint controller is responsible for the protection of personal data in accordance with the GDPR to the extent that it participates in the processing of the data.

3. §3. Your rights regarding the data

   In connection with the processing of your personal data, you have the right to:

   1. access the data,
   2. rectify it,
   3. request erasure of the data (where permitted by the GDPR),
   4. restrict the processing of the data,
   5. data portability,
   6. withdraw consent at any time (if the processing is based on consent).

   To exercise your rights you may contact the Controller – the contact details are indicated in §1.

4. §4. Right to object

   You have the right to object to the processing of your personal data when:

   1. the data is processed for direct marketing purposes – without the need to provide justification,
   2. the data is processed on the basis of the Controller’s legitimate interest – the objection requires justification based on your particular situation.

   You may submit an objection by contacting the Controller.

5. §5. Complaint to the UODO

   If you consider that the processing of your personal data infringes the law, you have the right to lodge a complaint with the supervisory authority:

6. §6. Cookies files

   Cookies are small text files saved on your end device. In the Service we use the following types of cookies:

   6.1 Essential cookies

   Purpose of use:

   • ensuring the correct operation of the Service
   • maintaining the user session
   • handling the cart and login
   • managing cookie consents
   • security of the Service

   Legal basis: art. 6(1)(b) and (f) GDPR in conjunction with art. 399(3) of the Electronic Communications Law (PKE).

   6.2 Analytical cookies

   Purpose of use:

   • analysis of user behaviour
   • optimisation of the structure and functionality of the Service
   • visit statistics

   Legal basis: art. 6(1)(a) GDPR (consent).

   6.3 Marketing cookies

   Purpose of use:

   • personalisation of content and offers
   • remarketing
   • displaying advertisements tailored to interests
   • reminders about an abandoned cart
   • surveys and satisfaction studies

   Legal basis: art. 6(1)(a) GDPR (consent).

   6.4 Withdrawal of consent

   You may withdraw your consent to the use of cookies (other than essential ones) at any time through the cookie settings available in the Service.

   6.5 Data processing period

   • Data processed on the basis of consent – until it is withdrawn.
   • Data processed under essential cookies – for the time necessary for the correct operation of the Service.

   6.6 Obligation to provide data

   The data processed by essential cookies is necessary in order to use the Service. The data processed by analytical and marketing cookies is voluntary.

   6.7 Transfer of data outside the EEA

   Data may be transferred outside the EEA on the basis of standard contractual clauses or a decision of the European Commission.

   6.8 Profiling

   Cookie data may be used for profiling (personalisation of advertisements), but this does not produce legal effects.
